These terms govern the use of inTouch — the app for iOS and Android and the browser version inTouch Web (together “the service”). The provider is Max Vogt, Rorgenwieserstraße 27, 78576 Emmingen-Liptingen, Deutschland (details in the Imprint). How we handle data is set out in the Privacy Policy.
inTouch is a messenger: one-to-one and group chats, voice and video calls, sharing photos, videos, voice notes, locations and contacts, as well as stories, posts, “flicks” and optional extra features (“add-ons”). Chat messages are end-to-end encrypted. Which content is not end-to-end encrypted (e.g. stories, posts, comments, calls) is explained in the Privacy Policy.
The service is currently free of charge. Its features may evolve; we will not discontinue essential features without reasonable advance notice.
You must be at least 16 years old. If the law of your country requires a higher age to consent to data processing, that age applies (e.g. 18 years in India).
You are responsible for the content you send or publish. In particular, the following is prohibited:
You can block other users in the app; blocked people can then no longer deliver direct messages, flicks or calls to you (this does not apply in shared groups). You can report posts, comments, stories and profiles that are unlawful or violate these rules directly in the app (“Report” in the menu of the content or profile); the reported content is hidden for you at once. You can report other violations to hello@in-touch.cc — please include a description and, where possible, a screenshot. We cannot read end-to-end encrypted messages ourselves; we only see what you send us in your report. We review reports promptly, tell you the outcome and may remove content or suspend accounts. If we remove content, we tell the person who created it the reason; they do not learn who reported it.
Your content remains yours. You only grant us the non-exclusive, royalty-free rights needed to technically store and transmit it and to show it to the recipients you choose, for as long as it is stored in the service. We do not use your content for anything else — in particular not for advertising or for training AI models.
Some features integrate third-party offerings, e.g. GIF search (GIPHY), weather data (Open-Meteo), maps (Google Maps or Apple Maps) or news and sports data. The respective providers are responsible for their content. If you connect your own external tools (e.g. an AI assistant) using your inTouch API key, you decide which data goes there and you are responsible for that tool.
We strive for uninterrupted operation but cannot guarantee it. Maintenance, outages or circumstances beyond our control may cause limitations. Keep important content safe with the app's backup feature.
We are liable without limitation for intent and gross negligence, for injury to life, body or health, and under the German Product Liability Act. For simple negligence we are liable only for breach of an essential contractual obligation (one whose fulfilment makes use of the service possible in the first place and on which you may rely), limited to the foreseeable damage typical for this type of contract. Otherwise liability is excluded. Statutory consumer rights remain unaffected.
You can delete your account in the app at any time (see Delete account). We may terminate with four weeks' notice if we discontinue the service, and, in case of serious or repeated violations of these terms, remove content and suspend or delete accounts without notice.
If we change these terms, we will inform you in the app at least six weeks before they take effect. You can object by deleting your account before they take effect; we will point this out in the notice. Changes that substantially alter the core service only apply with your express consent.
If you download inTouch from the App Store, Apple's Standard Licensed Application End User License Agreement (Standard EULA) also applies. Apple is not a party to these terms and is not responsible for the service, its content or support.
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, you keep the protection of the mandatory provisions of the country where you habitually reside. If any provision is invalid, the rest remains valid.
